Martin Casado argues AI laws should target harmful uses, warning regulatory uncertainty is pushing U.S. startups toward Chinese open-source models.
Martin Casado and colleagues argue that AI policy should regulate harmful uses rather than model development, since lawmakers cannot define AI reliably and its marginal risks remain an open research question. They compare the approach with cybersecurity, encryption, and social media: address demonstrated harms as they emerge, while preserving useful technology. Existing laws against discrimination, fraud, and other illegal conduct still apply to AI; any new rules should be technology-neutral and fill identified gaps. The panel warns that regulatory uncertainty is already chilling startup funding, hiring, and product development, including one AI-focused VC withdrawing a term sheet. Casado says about 80% of the open-source models used by companies he sees are Chinese, as U.S. firms hesitate to release strong models amid legal uncertainty. They argue that Chinese adoption could create lasting commercial and geopolitical influence, making evidence-based debate essential.
